Commonwealth v. J.R. – Quincy District Court (State Police)

Charge(s) – OUI 2nd offense, Unlicensed Operation of MV, Marked Lanes Violation, Negligent Operation of Motor Vehicle

Result: OUI – Not Guilty

Client was stopped in South Boston by Massachusetts State Police after rear ending another driver on the road. Another officer arrived on scene and said he had been following the client’s vehicle due to erratic driving. The officer observed observed the client’s eyes to be extremely glassy and bloodshot and his speech was very slurred. Officer also detected and overwhelming odor of alcohol emanating from the client and noticed he was bleeding from a cut to his hand. Client admitted to having one beer when asked if he had been drinking. At this time, EMS arrived on scene. Officer checked client’s license on his MDT and noticed it had been revoked for OUI. Client was taken to the hospital and was informed he would be receiving a summons to Quincy Court for OUI Alcohol, Marked Lanes Violation, Negligent Operation of Motor Vehicle, and driving without a license.
