Moving Forward After a Criminal Charge: There Is Always a Path

Criminal Charges Don’t Define You

Criminal charges are among the most frightening things a person can face, not just because of the legal consequences — the potential for incarceration, for a permanent record, for lost licenses and lost opportunities — but because of what they mean to your sense of who you are.

Most people who face criminal charges in Massachusetts are not bad people. They are people who made mistakes, or who found themselves in impossible situations, or who were in the wrong place at the wrong time, or who are facing accusations that don’t fully represent what actually happened. And even those who did make choices they regret deserve to have those choices assessed honestly and fairly, by a system that holds the government to its burden of proof and ensures that every person has the full protection of their constitutional rights.

What Criminal Defense Is Actually About

Criminal defense is about ensuring that the process is fair, that the evidence is legitimate, that the rights of the accused are respected, and that every person has an advocate who is genuinely fighting for their interests.

It is not about getting guilty people off — though it is true that many people who are arrested are not guilty of the charges filed against them, and that the presumption of innocence means that guilt is something the government must prove, not something we can assume. It is about ensuring that no person faces punishment without a fair process, that the government meets its burden, and that every human being in the courtroom is seen as a person first.

What We’ve Seen in Over Four Decades of Practice

Over the course of our careers, we have seen what makes the difference in criminal cases.

We have seen cases turn on the suppression of a single piece of evidence — a breathalyzer result excluded because of a calibration problem, a drug charge dismissed because the traffic stop lacked constitutional justification, a firearm excluded because the search exceeded its lawful scope.

We have seen cases turn on a cross-examination that revealed a witness’s inconsistency — a moment when the carefully constructed prosecution narrative collapsed under honest questioning.

We have seen outcomes change because of a mitigation argument that persuaded a judge to see a person rather than a charge — a real human being with a real story, real context, and a real future worth protecting.

We have seen clients walk out of courthouses who, in the early days of their case, were certain their lives were over.

We have also seen what happens when people navigate the system without the right help. Cases resolved in ways that could have been better. Opportunities missed. Rights not asserted. Long-term consequences not fully understood until it was too late to do anything about them.
