I found myself in a situation that I never thought I would be in – Arrested for OUI – I was panicking, stressed out, and beyond upset and lost – Jay was recommended by a friend and the minute I spoke with him on the phone (at 7 am day after arrest) he helped put my mind at ease – he explained what would happen when I went to my court appearance that morning – He told me what to say and what to expect. He was always there to answer any and all questions that I had ridiculous or not…..he never judged me, he was so calm and positive and factual with me – He knows the law and he knows how to represent anyone in this same situation – He explained everything and was so patient with all that I asked of him. He was especially patient with my tears that seemed to just keep flowing 😉 – knowing that I could not drive to meet him in person after my license was taken for the 30 days after arrest he went out of his way to meet me near my home, on a SATURDAY – I mean, really? This is just the type of person he is, thoughtful considerate and so caring – Not to mention that he is fair, honest and smart – The months leading up to my court date were stressful – A few days before my court date Jay called me just to ask me how I was doing – how kind is that?? He put my mind at ease by telling me that he would be with me every step of the way and would do his very best to get the best possible outcome at my trial – Day of trial we had to decide whether I would go with a jury trial or go before the judge only and waive the jury trial – i was panicked, I didn’t know what to do and he calmly explained how it would all work – Together we made the decision to go with a bench trial – I had confidence in him but of course was worried and sick over it hoping we made the correct decision. I didn’t testify at my trial – we talked about it and decided together that it wasn’t in may best interest – Jay’s expertise and his questioning of the State Police Trooper that arrested me blew me away – I sat there in awe of how Jay questioned this guy – He was firm but very direct with him asking him all sorts of questions and questioning him on most every detail of his not so detailed police report – I was just amazed that this awesome lawyer was doing this all for me – I could not have asked for a better verdict as I was found Not Guilty of OUI and it was because of how Jay handled this case – I am forever grateful and indebted to Jay – If you find yourself or someone you know needing an OUTSTANDING lawyer and all around good person please call Jay Milligan – I promise you will not be disappointed. Jay is a fantastic attorney. I was potentially looking at a second offense DUI, which would have horribly affected my life and work situation. I was panicked. I requested an inquiry on James’ website the day after my incident and was contacted immediately when it was a Sunday morning. My situation was unique because I was an out of state resident and license holder, but James still managed to inform me with a comforting amount of knowledge so that I knew how everything would play out. Throughout the process James was easy to contact, always responding in a short time if not able to contact immediately. I hired James Milligan for my 2nd offense OUI about a year ago. Yes a year ago I was unlucky to be charged with the 2nd OUI . It was rough. I didn’t know where to go and whom to call . The first lawyer from my first oui didn’t do a very good job so there was no way I was contacting him . Jay is everything you want in a defense attorney. I was fighting my 2nd OUI offense while still serving probation from my first OUI. When I violated probation Jay was by my side and fighting for me for everything. From the get go I knew he was going to fight for me when he accompanied me to the hearings officer at the RMV. Even though I wouldn’t get my license back, like Jay said would happen, I still knew he would get the job done. When I violated probation the D.A was asking me to go to a 2 week inpatient treatment program that would have cost me $2-3k. Instead he was able to get me a 24 Q which is way cheaper and easier to do. He was with me every step of the way, every court hearing, probation hearing and his tactics in the courtroom. How Jay was able to prove to the Jury that I was NOT GUILTY on my 2nd OUI offense was really something to witness. He went through the police report with the arresting officer and questioned him hard and the officer had no answer for Jay. He also questioned the only witness and had nothing incriminating to say. If I didn’t hire Jay I’d be looking at a 8 years loss of license and about $8-10k in fines instead it was about 2 years without a license (which I am getting back soon) and a NOT GUILTY verdict. If you want to win your case I strongly recommend hiring James Milligan.

I hired Jay Milligan because he was highly recommended by a close friend. When I met him for the first time my gut instinct told me he was the type of attorney who would fight for me. I was so confused and embarrassed by my recent arrest. He was so understanding and judgment free. Thankfully my gut instinct was right!! My case went back to an arrest for OUI in 2015. Patience pays off! Mr. MIlligan was part of a study proving the breathalyzer used for my case was not correctly calibrated, that the trooper was just making his quota, and most importantly that I was not an intoxicated driver. 2018 my case went to trial with a NOT GUILTY finding and it’s all thanks to Jay. Jay successfully defended me in a DUI charge liquor early this past year. Although I was not found guilty of the charge, I was found guilty of a lesser charge of driving to endanger. I was given a year probation with a restriction on alcohol consumption. I violated the probation and risked probation being revoked. Jay and his associate, Joe were able to reinstate probation to avoid further life disruptions. I would highly recommend using his services.

I was pulled over in cape cod mass in the summer of 2016. Read reviews online, saw attorney Jay Milligan’s profile, and decided to give him a call. I ended up hiring him and he advised me of the various steps we would have to take. He advised me his office would file through several motions that would cause me to show up in court for each appearance. It was not something I was thrilled about being that I lived 3.5 hours away and I would have to take random days off. Nor did I feel each time I went up there I got anywhere. Including one time I made the drive to find out that morning they had to reschedule which made me a little upset. I even felt that a dui case should not take a year to render a verdict. Nonetheless, leading up to the trial period I did not feel confident at all. A year later, we had the trial. Feeling uneasy about everything that was about to happen, my mind suddenly changed once I heard attorney Milligan present himself to the judge and realizing why I had to go through everything in the past year. He had a confidence and poise to him, but more importantly asked the right questions and followed it up with the right statements that gave me an extreme set of confidence in my verdict. Even if things didn’t go my way I was going to shake his hand and thank him because I was very happy with his performance in court. To my satisfaction, I was given a not guilty verdict. I do want people to understand when reading this, I blew a .08, I skipped a couple letters in the alphabet, and passed every other test. Let me begin by stating I have a Very unique case history, in that I have been Charged & Convicted of (3) three DUI 1st Offenses. October 1997, Framingham, MA

September 2011, Rhode Island

July 2013, Middleton, MA’

And I should inform you, that in all (3) cases I failed a Field Sobriety Test and Breathalyzer Test.

Following the 2013 case, being convicted of only a 1st Offense and sentenced to 90-Day Suspended license, and installation of a Breathalyzer device, I proceeded to the DMV to apply for a “Hardship”/” Cinderella License. I was told to have the ignition device installed and to come back with the appropriate paperwork. When I returned, I was told the DMV story changed, they stated that my License would probably be suspended for (8) Years, Looking back at all Three Convictions. I immediately contacted my attorney from my latest case (2013 Middleton) Martin Kane. Martin, not handling many DUI cases at the time, referred me to Jay Milligan, and called him a “DUI Miracle Worker”.

Attorney Milligan looked over my unique case and immediately had a plan of action. He told me he was going to attempt to get my 1997 Conviction Vacated. I know what you are thinking and I was thinking the same thing, HOW THE HELL is he going to do that? I Failed the Sobriety Test, I failed the Breathalyzer Test, what did he have to work with? Attorney Milligan proceeded as planned despite my disbelief and Filed A MOTION FOR A NEW TRIAL. Apparently, the paperwork from my 1997 Arrest had a BOX that stated “I had the right to a Jury Trial”, that Box was left UNCHECKED by the Judge. This unchecked Box got our foot in the door for a new trial.

Next, we WAITED, 6-8 months for the Judge that presided over my 1997 case to RETIRE. You know what they say “Timing is Everything”. After the Judge’s retirement Attorney Milligan and his team submitted the paperwork for the New Trial, and 6-8 months later the new trial was granted. Attorney Milligan was even more confident, so confident that he believed the STATE would Drop All Charges before the court date. That was not the case. When the state was asked to produce the key witness, The Arresting Officer they could not do so. Remember it has been 19 Years since the arrest, the arresting officer has retired to Florida and refused to travel back to Massachusetts to testify. Result, CASE CLOSED, ALL CHARGES DROPPED! As if it never happened, I can’t tell you how many times I wished I had a Time Machine, and could go back and Erase that mistake (And a few others). Now I have a Time Machine and his name is Attorney Jay Milligan.

Now with the 1997 Conviction ERASED from my record, it’s time to schedule a hearing with the DMV to reinstate my driving privileges.

I can’t say enough good things about what Jay did for me. my wife and I went out for dinner last summer. I was pulled over for my headlights being off. I had mistakenly switched them off the automatic position earlier that day looking for the wiper switch. this was my wifes new car and I hardly ever drove it. Jay Milligan saved my life. As a first time offender, I was charged with an aggravated DUI charge after another person was injured in an accident I was involved in, which is a felony in Massachusetts. I was looking at a mandatory six to twelve months in state prison. Jay helped to facilitate an agreement with the victim on the pending civil case I was also involved in and used that as leverage to convince the district attorney to reduce the charges against me, effectively eliminating any mandatory prison sentence. I was arrested and charged with a third offense OUI and leaving the scene after causing property damage. I was devastated over the five year license loss for refusal of the breath test and the possibility of five months mandatory jail time with an additional eight years loss of license. Hiring the right attorney was one of the biggest decisions of my life. After doing some research, Jay Milligan had the most experience and best reputation. After our first consultation, I felt like he was the right guy and his fees were fair given the severity of the case. Hiring Jay was the best decision I made. I used an attorney for a past incident and found him ill prepared and unfamiliar with some of the facts of my case a day prior to trial. I am from out of state and I am a cdl truck driver. I was pulled over in Massachusetts in my commercial vehicle for oui. When faced with an OUI charge as I was, it’s traumatic. The effects of the outcome of the case will have serious lifelong repercussions professionally and personally. I needed an attorney with experience and expertise specifically in DUI matters. Additionally I needed an attorney who knew the court where I was being tried. I weighed this heavily in my decision to choose James Milligan. I called him on a Saturday and he called me back that day. I had to appear in court on Monday at 8:30am and the court was already informed that Jay was my representation.

When you go through the legal process you spend a good deal of time in the courtroom and observe a lot, this reaffirmed to me that I made a very wise decision in choosing Jay for my representation. I can’t say enough about how strongly I recommend Jay Milligan. He is well respected in the courts by the DA’s office, his fellow attorneys, the clerks, employees of the court and the judges. His courtroom demeanor is exceptionally polished.

I had a difficult case that included a police report with some alleged incriminating statements I had made at the time of my arrest. Jay from the very start had a strategy that included filing a motion to suppress evidence to get the Officers who wrote the report on the stand under oath. Jay worked through most of the items he wanted to suppress with the DA but there was one outstanding item they needed to argue. During the motion hearing he was able to cite case law to the Judge, she was going to give him time to respond back to her with the case law, which was unnecessary because Jay knew the law off the top of his head. This ultimately resulted in a favorable outcome on that portion of my case. He was also able to walk through the police report and alleged statements I made with the officers under oath during the motion hearing. This was critically important to the outcome of my case.

We took my case to the Jury trial, throughout the process Jay advised me of the options, the pros and cons. He went through my testimony several times to ensure I was prepared. He did the same with my witness. I knew what to expect at trial from reviewing the potential jurors to how the trial would unfold. At trial there was very little evidence for the prosecution since most of the police report had successfully been suppressed. He was able to show one of the officers who had already testified differently previously under oath (from the motion hearing) and had a transcribed copy of the testimony which he had the officer read out loud to the jury. After Jay’s questioning the other officer agreed that my behavior could have been the result of the airbag deployment (my arrest came as a result of a car accident). We were prepared with a timeline of the day, extensive documentation to support the timeline and how the day unfolded. Jay was prepared, like able and factual. The end result was a Not Guilty verdict by the jury. I can’t thank Jay enough for his impeccable representation in a very difficult case.

Getting arrested for OUI, especially if you’ve never been arrested before, is scary and anxiety provoking. Therefore, you need an attorney who is an expert in this field to represent you. Attorney James Milligan is an expert and more. His self-confidence in his skills had the effect of calming me down throughout the process. I’d say to myself “Jay has been doing this for 16 years, this is all he does, so if he says X is going to happen, the X will happen. Trust in Jay.” Jay is very responsive, as he would call me back within a short time frame, even if he had to give up his lunch hour, evening or weekend. He even spoke with me after business hours. For example, I read something on the Internet that scared the heck out of me. I texted him on a Saturday, and didn’t expect him to call me back until the following Monday. I’m a 52 year old mom of 3 grown boys. No parking or driving tickets, nothing. Late in the morning on Thanksgiving 2013 my husband and I left my sisters house down the cape, only vehicle on the road and I got pulled over. My husband and I were unsure of which exit to take, as a result I went over the fog line multiple times. Just as I was putting on my blinker and began my exit off the road onto the appropriate highway exit. Blue lights. The officer asked where I was going and where I was heading and if I had anything to drink. I said I was coming from my sisters where we spent the holiday, that I was heading home and that I had a couple of glasses of white wine. He asked me to get out of the vehicle and walk to the back of the vehicle. At this point another officer had arrived for backup, he said he was going to give me the breathalyzer and it was in my best interest to do it. He then administered field sobriety tests. Which I did well on. Then I was told I was placed under arrest. At the station I was given the breathalyzer again, the sergeant said I was just over the legal limit, this was the first time they told me this. At this point it was hours from the original time of pulling me over. My husband bailed me out a few hours later. Early the next morning, I was in the courtroom pleading not guilty and foolishly saying I was representing myself. The judges reaction made me think twice about that. I am glad I did. When I got home I googled “best OUI attorneys on south shore” . The top two people came up, Mr Milligan and another. I called the other one first, and left a message. I called Mr. Milligan and immediately he called me back. By the time 6pm that evening he had already reviewed the police report I emailed him and he called me again and told me what he thought my chances were. I never did get a call back from the other attorney. Attny Milligan was able to get the breathalyzer thrown out as well as a sentence I said that they documented. Be patient and have faith. I was found not guilty within a half an hour by a jury.

I had an incident which I thought I could fight. Jay was recommended to me with high regards, through another lawyer from New Hampshire. He assessed my situation and told me we had a very good chance to fight and win the case. After several continuations implemented by the DA, due to absent officer witnesses, we finally had my trial. Jay suggested the best course of action was a trial without a jury. The DA presented 3 officer witnesses and 5 pieces of evidence. Jay was able to determine the results from my breathalyzer as non-admissible using proof from another case file. When questioning the arresting officer, Jay persuaded him to admit that my performances in the field sobriety tests were not as harsh as initially described in his police report. Through Jay’s line of questioning, the officer also admitted to not clarifying his direction throughout these tests as specifically as he could have. The other two officers were proven useless for the DA. One admitted to not being able to fully judge my level of intoxication. The other was questioned to prove the functionality of the breathalyzer, this person’s testimony proved worthless as well. The style of which Jay decided to approach the case was incredibly sensible and proved itself successful.

I have never been in trouble with the law or arrested before so when I got my DUI it was pretty devastating especially since my career as a mechanic involves driving cars all day. I complied with everything the officer asked of me and answered with yes sir and no sir. I stepped off the line a few times and could not stand on one foot for more than 15 seconds however I did successfully count backwards from 66-33. The officer placed me under arrest and put me in the cruiser. On the way back to the station the officer advised me “off the record” to define the breathalyzer due to my career situation. Once I got to the station and was handed the paperwork with my charges I realized that the penalty for refusal was a license suspension for 180 days but if I took the breathalyzer and failed I would only lose it for 30 days. Not even thinking about court and just wanting to be able to work I took it and failed with a .12bac. I did some research online and contacted Mr. Milligan who was eager to help me as if I had already known him for years and was very knowledgeable about the information and steps that I needed to proceed. After many continued court dates, Mr. Milligan got the breathalyzer evidence to be withheld from the courtroom and got the jury waived so only the judge would be deciding my case. While interrogating the trooper he pointed out everything I did right that night in comparison to what I had not and the final outcome was that I was not guilty. I would highly recommend James Milligan to anyone who is thinking of fighting their DUI.

Mr. Milligan immediately put me at ease. I needed a hardship license for a 2nd DUI within 10 years per MA DMV ruling. I was unaware of Melanie’s Law and the lifetime look back. My previous citation was 8 years ago and so I initially thought this new citation was a 1st offense since my previous state of residence looks back 5 years. When the reality of this fiasco became clear I was more than distraught. Mr. Milligan answered and/or promptly returned all my calls which were many. James Milligan has “saved my life”… twice. I first started working with James (Jay) when I was 20 years old. I had gone through a roadblock, taken a field sobriety test & was arrested by the Massachusetts State Police for an OUI charge. Being under 21, I was looking at a loss of license for 3 years. Jay had looked over my case and peeled back any mistakes or questionable things the police had done and got my license back after 30 days and had to go to alcohol classes for 3 months. When the trial date came, the case was dismissed. I was so relieved and couldn’t have asked for a better lawyer than Jay. About 6 months ago, i was pulled over for a moving lane violation, where the State Trooper had come to the conclusion that i was operating under the influence. I refused the field sobriety this time, but agreed to go into the station with the trooper to take the breathalyzer. Once I got to the police station I politely asked if I could call my lawyer (Jay), I wasn’t sure if i was making the right decision. I called Jay at 1:00am and left him a message. He immediately called me back and walked me through the steps of what I needed to do, so I took the breathalyzer. When the trooper told me the results of the breathalyzer test, he had informed me that i “passed” with a .07. Relieved, I got a ride from the barracks to my home (I still have to get my car out of the tow yard later that day). Once the morning came, I had to go to the courthouse for my summons. Before I walked in Jay had called me to see how it all went. I informed him that i passed with a .07 and that i was at the courthouse and didn’t understand why i had to be there if i passed. Jay took the time to explain to me that just because my first OUI was dismissed, I can still be on trial for a 2nd offense, and the Commonwealth of Massachusetts can prosecute a .06 or a .07. Later that day I went to Jay’s office, showed him all of the police reports etc. Once again, He amazed me with all of the things he found wrong with the report. I never had a loss of license, i didn’t have to take any courses or anything like that, and just yesterday we went to trial for my case. I must admit I had gotten a little nervous hearing the Commonwealth question the arresting trooper. Now it was Jay’s turn. The second i heard him start talking i knew i was in good hands. All of my nerves went away as I listened to Jay question him. In the end, the judge (I waived my right to a jury) had found me not guilty. It is pretty safe for me to say that Defense Attorney Jay Milligan is a life saver. At the age of 19 I was in a car accident and arrested for an OUI. Not knowing I was allowed to deny the breathalyzer, I took it and blew a .18. However I wasn’t nearly that intoxicated and my sobriety tests proved this. After reading my police report, Jay didn’t think the sobriety tests matched up with my BAC so he asked if I had a history of acid reflux, which I do. He began to tell me that acid reflux has a high percent of error with breathalyzers because the air comes from your stomach not your lungs, and he knew a specialist who could speak about this to a jury. My case dragged on for a long fourteen months, repeatedly being pushed back for reasons that were no fault of my own. No matter how many times Jay asked for it to be dismissed the judge would not budge. At one point he even said to me that even though I may have a good lawyer, he’s no miracle worker and the commonwealth has a good case against me. It was an extremely nerve racking point in my life but everytime I met with Jay he was very confident about my case which made it a lot easier to deal with. As expected, I was shocked, worried about my future, and felt helpless when I received my charges. I was still in school at the time and if I were found guilty for the previously mentioned charges, my future and career would be significantly affected.

I had a difficult case that included a police report with some alleged incriminating statements I had made at the time of my arrest. Jay from the very start had a strategy that included filing a motion to suppress evidence to get the Officers who wrote the report on the stand under oath. Jay worked through most of the items he wanted to suppress with the DA but there was one outstanding item they needed to argue. During the motion hearing he was able to site case law to the Judge, she was going to give him time to respond back to her with the case law, which was unnecessary because Jay knew the law off the top of his head. This ultimately resulted in a favorable outcome on that portion of my case. He was also able to walk through the police report and alleged statements I made with the officers under oath during the motion hearing. This was critically important to the outcome of my case.

We took my case to the Jury trial, throughout the process Jay advised me of the options, the pros and cons. He went through my testimony several times to ensure I was prepared. He did the same with my witness. I knew what to expect at trial from reviewing the potential jurors to how the trial would unfold. At trial Jay was able to expose one of the officers who had already testified differently previously under oath (from the motion hearing) and had a transcribed copy of the testimony which he had the officer read out loud to the jury. After Jay’s questioning the other officer agreed that his observations could have been the result of the airbag deployment (my arrest came as a result of a car accident). Jay is everything you want in a defense attorney. From the get go I knew he was going to fight for me when he accompanied me to the hearings officer at the RMV. Even though I wouldn’t get my license back, like Jay said would happen, I still knew he would get the job done. He was with me every step of the way, every court hearing, probation hearing and his tactics in the courtroom. How Jay was able to prove to the Jury that I was NOT GUILTY on my 2nd OUI offense was really something to witness. He went through the police report with the arresting officer and questioned him hard and the officer had no answer for Jay. He also questioned the only witness and had nothing incriminating to say. Let me begin by stating I have a Very unique case history, in that I have been Charged & Convicted of (3) three DUI 1st Offenses.

October 1997, Framingham, MA

September 2011, Rhode Island

July 2013, Middleton, MA’

And I should inform you, that in all (3) cases I failed a Field Sobriety Test and Breathalyzer Test.

I immediately contacted my attorney from my latest case (2013 Middleton) Martin Kane. Martin, not handling many DUI cases at the time referred me to Jay Milligan, and called him a “DUI Miracle Worker”.

Next, we WAITED, 6-8 months for the Judge that presided over my 1997 case to RETIRE. You know what they say “Timing is Everything”. After the Judge’s retirement Attorney Milligan and his team submitted the paperwork for the New Trial, and 6-8 months later the new trial was granted. Attorney Milligan was even more confident, so confident that he believed the STATE would Drop All Charges before the court date. That was not the case. When the state was asked to produce the key witness, The Arresting Officer they could not do so. Remember it has been 19 Years since the arrest, the arresting officer has retired to Florida and refused to travel back to Massachusetts to testify. Result, CASE CLOSED, ALL CHARGES DROPPED! As if it never happened, I can’t tell you how many times I wished I had a Time Machine, and could go back and Erase that mistake (And a few others). Now I had a Time Machine and his name is Attorney Jay Milligan.

Now with the 1997 Conviction ERASED from my record, it’s time to schedule a hearing with the DMV to reinstate my driving privileges.

I was recently charged with a 2nd oui offense and though my state police report read well there are many outcomes that could put my life and license in jeopardy for a long time period.
