Commonwealth v. W.S. – Quincy District Court (Weymouth Police Department)

Charge(s) – OUI, Negligent Operation of Motor Vehicle

Result: OUI – Dismissed

Client was stopped by Weymouth police after reports were made that her vehicle was all over the road and nearly hit a pedestrian. The client had also struck the rear end of another vehicle. The officer had difficulty communicating with the client and asked her several times to put the car in park and turn it off before he had to do so himself. Client had difficulty answering questions and could not produce a license. The officer detected a strong odor of alcoholic beverage emanating from the client and noted her speech was slurred and hard to understand. Client was asked if she spoke english, to which she replied she did. Officer asked the client to undo her seatbelt and exit the car. When she could not do so the officer did for her and noticed she had urinated. Client was unsteady on her feet upon exiting the vehicle. Officer tried to administered a series of field sobriety tests. Client failed both and was placed under arrest.
