WHAT ARE MY OPTIONS FOR MY FIRST DUI?

 You have 2 options, you either plea/admit to the charges or you can fight the case. If you take a plea, you will likely receive a standard first offenders disposition.  Every case is different and you may receive additional conditions of probation not listed below.

• License Revocation for One (1) year, with work hardship eligibility after three (3) months and general hardship after six (6) months.
• Alternative Disposition under G.L. 90, s. 24D License can be suspended from 45-90 days or for 210 days for a person under the age of 21.
• Hardship license eligibility attaches after 3 business days from the date of disposition or guilty finding.  The hours are for any 12-hour period during the day seven days a week.  You are not guaranteed to be eligible for a hardship, it has become very tricky to get a hardship license.

If you fight your case and win, upon order of the court your license will be returned. If you fight your case and lose, the penalties will likely be the same as above.  The only difference is that if you lose after a trial, you will receive a conviction.
